As the Human Rights Association, we would like to inform you about the “Law No. 6698 on the Protection of Personal Data,” which regulates the obligations of real and legal persons that process personal data and the procedures and principles to be followed in order to protect fundamental rights and freedoms, especially the right to privacy, in the processing of personal data, taking into account the security of our members, volunteers, applicants or anyone who has shared any personal data with us by contacting us in any way.
Even before the introduction of any legal regulation, our Association placed great importance on the confidentiality of personal data and adopted this as a working principle. Nevertheless, you can be sure that we will treat your suggestions for improvement, your applications and possible complaints with sensitivity.
INFORMATION AND CONSENT TEXT FOR THE PROCESSING OF PERSONAL DATA
WITHIN THE SCOPE OF THE LAW ON THE PROTECTION OF PERSONAL DATA
The purpose of this informed text is to inform you, as members and applicants of the association, in the most transparent way possible about the collection, processing, method and purpose of processing, legal reason, to whom and for what purpose your personal data can be transferred, and your rights under the relevant law within the scope of the Law No. 6698 on the Protection of Personal Data (“Law”) - in accordance with Article 10 of the Law.
Pursuant to Law No. 6698 on the Protection of Personal Data, your personal data may be processed by the Human Rights Association (İHD) as the data controller in the manner described below and within the limits prescribed by the legislation:
1. Collection, Processing, Collection Method, Purpose of Processing and Legal Reason of Personal Data
İHD, in order to realize the purpose of “promoting human rights and freedoms” explained in Article 2 of the association’s charter and due to its activities for this purpose (explained in Article 3 of the same charter), as well as in order to fulfill its obligations arising from the law and ordered by competent institutions and authorities in a complete and correct manner, all kinds of personal data that you have submitted to İHD or that İHD acquired within the framework of its activities and transactions carried out in line with the purpose of the association; in accordance with the Law and within the limits set out in the Law, it will be able to obtain, record, store, preserve, update, change, rearrange, disclose, transfer, share, classify, anonymize, and process in other ways listed in the law, either verbally, in writing or electronically through the headquarters of the association or through the website, social media channels, mobile applications and similar means, in accordance with the Law and within the limits set out in the Law, by automatic or non-automatic methods, in cases and to the extent permitted by the Law.
Your personal data is collected by automatic or non-automatic means, in written, verbal or electronic media, since data processing is mandatory for İHD to carry out its activities listed in its charter, that is, to promote, exercise or protect fundamental rights and freedoms. Your personal data collected for this legal reason can also be processed and transferred for the purposes specified in this text within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the Law.
2. To whom and for what purpose the processed personal data can be transferred
Your personal data is collected, in line with the purposes of İHD laid out in its charter, for the purposes of carrying out the necessary work by the association’s headquarters, branches and representative offices for the realization of these activities with the working subjects and forms of work specified in the same charter and for the execution of the related working processes; third persons, real persons and/or legal entities (at home and abroad) with whom the association is in contact, the association’s representative offices/branches at home and abroad, international institutions and organizations, legally authorized public institutions and private persons and the association’s members within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of Law No. 6698.
3. Rights of the Personal Data Owner within the framework of Article 11 of the Law on the Protection of Personal Data
As personal data owners, if you submit your requests regarding your rights to İHD in writing, İHD will finalize the request free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, a fee determined by the Personal Data Protection Board may be charged by İHD.
In this context, by applying to İHD as a personal data owner you have the following rights:
a) to learn whether your personal data is being processed,
b) to request information if your personal data has been processed,
c) to learn the purpose of processing your personal data and whether it is used in accordance with its purpose,
d) to know the third parties to whom your personal data is transferred domestically or abroad,
e) to request correction if your personal data is incomplete or incorrectly processed,
f) to request the deletion or destruction of your personal data in the event that the reasons requiring its processing disappear, although your personal data has been processed in accordance with the provisions of the Law and other relevant laws,
g) to request notification of the transactions made in accordance with subparagraphs (d) and (e) above to third parties to whom your personal data are transferred,
h) to object to the occurrence of a result to your detriment due to the analysis of your personal data exclusively by automated systems, and
i) to demand compensation in case you suffer damage due to unlawful processing of your personal data.
Pursuant to paragraph 1 of Article 13 of the Law, the channels and procedures for submitting your request to exercise your above-mentioned rights are described below:
In order to exercise your above-mentioned rights, you can fill out the application form on İHD's website and submit in person or send a signed copy of the form to Korkutreis Mahallesi, Necatibey Caddesi, No: 82/11-12 Çankaya/Ankara with documents identifying your identity, through a notary public or by registered mail with return receipt requested.
Moreover, we would like to kindly inform you that with the subparagraph 3 of the provisional first article of the Law No. 6698 on the Protection of Personal Data, it is stipulated that the consents obtained in accordance with the law before the publication date of this Law (07.04.2016) will be deemed to be in accordance with this Law, unless a contrary declaration of will is made within one year.
4. Cases that do not require consent
Pursuant to paragraph 2 of Article 5 of the Law No. 6698 on the Protection of Personal Data, it is necessary to process personal data belonging to the parties to the contract, provided that it is clearly stipulated in the law, it is directly related to the establishment or performance of a contract, it is mandatory for İHD to fulfill its legal obligation as data controller, and it has been made public by the person concerned, İHD has the right to process personal data without obtaining explicit consent in cases where data processing is mandatory for the promotion, exercise or protection of a right, and data processing is mandatory for the legitimate interests of İHD, which is the data controller, provided that it does not harm the fundamental rights and freedoms of the person concerned.
Pursuant to Article 10 of the Law No. 6698 on the Protection of Personal Data titled “Obligation of the Data Controller to Inform,” I have read and understood this “Information Text” explaining by whom and for what purpose my personal data will be processed, to whom and for what purpose the processed personal data can be transferred, the method and legal reason for collecting personal data and my rights under Article 11 of the Law and I have been informed in detail by İHD as the data controller.
