CRIMINAL COMPLAINT AGAINST THE LEADER OF THE COUP D’ETAT WHO EASILY CONFESSED THAT THE LEADERS OF THE JUNTA HAD UNLEASHED THE TORTURE SO THAT SECURITY FORCES COULD WORK COMFORTABLY.

Milliyet newspaper has been giving place to interviews made with retired generals. Retired generals have been making important comments about the “Kurdish problem” which has been the source of the violence spiral that Turkey had floated. Yesterday ex-chairman of the general staff and leader of military administration of coup d’etat, Kenan Evren’s explanations took place in the newspaper. Evren made very important explanation about his thoughts and activities during the years that he was in power by saying that “as if there were no torture in police stations before coup? It was in all the stations. Ill-treatment was made when one got in to a police station in 12th of September we freed the police to work comfortably.” These confessions have importance with political and legal consequences for our organizations that have been working to end torture in Turkey and all over the world.

In the period which began with Kenan Evren and his friends took power with a coup d’etat, 650,000 people were detained and 171 people were killed with torture. Torture and other human rights violations were so heavy, intense and frequent that Human Rights Association (IHD) and Human Rights Foundation of Turkey (HRFT) were founded to stop these violations and to cure the wounds these violations caused. As a matter of fact thousands of people who were tortured in that period, applied to HRFT for treatment and rehabilitation after the foundation of HRFT in 1990.

The facts about torture which were uttered by the defenders of human rights especially in the period of military administration denied by the member of junta and personally by Kenan Evren. Moreover one who uttered the facts faced with pressures, investigations and cases with proclamations of treason.

But today Kenan Evren confessed the bitter and naked truth. Truth that “torture and ill-treatment is the systematic state practice in this country that gone on from a long time.” This confession that he made as he tried to explain that he and the military administration is not responsible for the incidents that took place, can be a soul searching of lapse of tongue but in any case it is an open “confession of a crime”. Because practises of security forces like torture can not go on for a long time without the approval and beyond their cognizance of the administration as Evren confessed. It is not an ordinary practise. It is a practice absolutely forbidden and named as crime against humanity by laws, constitutions and by international treaties that Turkey approved.

Everyone, especially Kenan Evren, who was in charge in the period of coup d’etat, is responsible from all the torture incidents and other human rights violations. Because the most responsible person of that administration confessed that he is the real solicitor by saying that “we freed police to work comfortably. They did it again…”

Still the more serious thing is the attempt of Evren to legitimate torture and ill-treatment. According to Kenan Evren, “before 12th of September…the guardians of Diyarbakir Prison suffered a lot. They took their revenge after 12th of September.” These words are for legitimize torture and ill-treatment which are unacceptable under any condition. And it is open expression of the mentality of the torturers for that day.

The main reason of the continuity of torture in Turkey and all over the world is the fact of impunity. For this reason the national and ultra-national law do not determine a spatial or time limit for the sentence of torture. In order to bury this shame of humanity to the junk of history, everyone who is responsible from torture should be tired and sentenced with justice. Because of this we invite the prosecutors to lunch an investigation concerning the confessions of KenanEvren.

We all know what would happen to prosecutors in this country from the Semdinli Case. If public prosecutors can not gather courage and responsibility we hope and demand at least accurate evaluation of our criminal complaint.
