On December 11, 12 and 13, the associations of the families of the disappeared from all the region – Algeria, Spain, Iraq, Cyprus, Turkey, Morocco, Bosnia-Herzegovina, Serbia, Kosovo, Lebanon, Libya – and from other continents, also several Turkish and international NGOS as some experts met on the thematic of “transitional justice and enforced disappearances”, within the framework of the Third Euro-Mediterranean Meeting of the Families of the Disappeared. This event was organized by the Euromed Federation against Enforced Disappearances (FEMED), in partnership with YAKAY-Der, Mothers for peace and the Turkish Human Rights Association (IHD).
On the one hand, the Meeting has allowed the participants to know better the different mechanisms of transitional justice and particularly the Truth and Justice Commissions, their potential, their limits; to improve the analyze on the tensions which exist between the objectives of peace and justice; to have a reflexion on the potentials and the dangers of the different types of amnesty; to stress on the preservation of Memory and particularly the Human Rights archives; to underline the importance of the reparations for the families of the disappeared; to promote the organizations and the technologies which aim to identify the bodies.
At the end of these three days, the participants of the Euro-Mediterranean Meeting of the Families of the Disappeared call
The countries of the region to:
– put immediately an end to the practice of enforced disappearances;
– to put an end to the secret detentions within the framework of the counter-terrorism;
– to begin or to continue the dialog with the associations of the families of the disappeared in order to have an integral solution to the disappeared issue;
– to give affectivity to the rights to Truth, Justice, and integral reparation to the victims of the enforced disappearances and their families;
– to facilitate the research and the establishment of Truth with the protection of the mass graves and the places of secret detentions;
– to respect the rights of the relatives and the Human Rights defenders, particularly their right to the freedom of association, of expression and of demonstration.
– To recognize officially the responsibility of the State in the enforced disappearances and to apologize publically.
The Turkish authorities:
– to release the persons who are arbitrarily detained and to stop the harassment against human rights defenders;;
– to start immediately an independent program of exhumation and identification of the bodies and to give it back to their families in order for them to find the mass graves, particularly the Kurdish provinces;
– to establish a centralized data base of the genetic information of the families of the disappeared and of the bodies;
– to start prosecutions in order to establish the individual responsibilities and to sanction the authors of enforced disappearances.
The international community:
– to sign and ratify the International Convention for the Protection of all persons from Enforced Disappearances and to recognize the competence of the Committee against Enforced Disappearances to receive individual complaints.
– to reinforce the international mechanisms for the protection of human rights which have the competence to deal with the cases of enforced disappearances, notably the Working Group on Enforced or Involuntary Disappearances.

DECLARATION DE LA TROISIEME RENCONTRE EURO-MEDITERRANEENNE DES FAMILLES DE DISPARUS
Les 11, 12 et 13 décembre 2009, les associations de familles de disparus venues de toutes la région euro-méditerranéenne – Algérie, Espagne, Irak, Chypre, Turquie, Maroc, Bosnie-Herzégovine, Serbie, Kosovo, Liban, Libye – et des autres continents, des ONG turques et internationales ainsi que des experts se sont réunis autour du thème « la justice transitionnelle et les disparitions forcées, dans le cadre de la Troisième Rencontre Euro-méditerranéenne des Familles de Disparus. Cet événement a été organisé par la Fédération Euro-méditerranéenne contre les Disparitions Forcées (FEMED), en partenariat avec YAKAY-Der, Mères pour la Paix et la Ligue turque des droits de l’Homme (IHD).
D’une part, la Rencontre a permis aux participants de mieux connaître les différents mécanismes de justice transitionnelle et en particulier les commissions de vérité et de justice, leurs potentiel et leurs limites ; de mieux analyser les tensions qui existent entre les objectifs de la paix et de la justice ; de réfléchir sur les potentiels et les dangers des différents types d’amnistie ; de mettre l’accent sur la préservation de la mémoire et en particulier des archives de droits de l’Homme ; de souligner l’importance des réparations pour les familles de disparus, en tenant compte de l’impact différencié des violations sur les hommes et les femmes ; de mieux faire connaître les organisations et les technologies qui visent à identifier les dépouilles.
Au terme de ces trois jours de travaux, les participants de la Troisième Rencontre Euro-méditerranéenne des Familles de Disparus appellent :
Les Etats de la région à :
– Mettre fin immédiatement à la pratique des disparitions forcées ;
– Mettre fin aux détentions au secret sous couvert de la « lutte contre le terrorisme » ;
– Entamer ou poursuivre le dialogue avec les associations de familles de disparus pour parvenir à un règlement intégral de la question des disparus ;
– Rendre effectifs les droits à la Vérité, à la Justice et à la Réparation intégrale des victimes de disparitions forcées et de leurs familles ;
– Faciliter le travail de préservation de la mémoire, notamment par la protection des archives,
– Faciliter la recherche et l’établissement de la vérité par la protection des charniers et des lieux de détentions secrets ;
– Respecter les droits des proches de disparus et des défenseurs des droits de l’Homme, en particulier leur droit à la liberté d’association, d’expression et de manifestation.
– Reconnaître officiellement la responsabilité de l’Etat dans les disparitions forcées et de présenter des excuses publiques.
Les autorités turques à :
– Libérer les détenus emprisonnés arbitrairement et arrêter le harcèlement des défenseurs des droits humains ;
– A entreprendre immédiatement un programme indépendant d’exhumation et d’identification des dépouilles et leur restitution à leurs familles qui se trouvent dans des charniers, en particulier dans les provinces kurdes ;
– Etablir un fichier centralisé sur les données génétiques des familles de disparus et des dépouilles ;
– D’entreprendre des poursuites pénales pour établir les responsabilités individuelles et sanctionner les auteurs de disparitions forcées.
La communauté internationale à :
– Signer et ratifier la Convention Internationale pour la Protection de toutes les personnes contre les Disparitions Forcées et à reconnaître la compétence du Comité contre les disparitions forcées à recevoir des plaintes individuelles ;
– Renforcer des mécanismes internationaux de protection des droits de l’homme ayant la compétence de traiter des cas de disparitions forcées et notamment le Groupe de travail sur les disparitions forcées ou involontaires.
